Abstract

One of the current causes of climate change is the national philosophy of the functional transfer of land from wetlands, paddy fields, watersheds, protected forests, coastal and lake reclamation into residential areas. Initially, these locations provide humans and the environment with cool, clean air, but as their functions shift, pollution and climate change—which led to global warming—appear. Because it affects human life, the transition of land functions is prohibited from a philosophical standpoint. From a sociological perspective, human actions that intentionally harm the environment by converting agrarian lands into residential areas, factories, hotels, and large shopping malls must be illegal due to land misuse rather than the public interest. As a result, juridical, a regulation that will be highlighted from the criminal law aspects in the case of criminal acts, criminal liability, and the formulation of the punishment system against any person or legal entity that is proven to have committed criminal acts in the case of abuse of land functions, resulting in the climate change that threatens human safety. The normative juridical approach is used in this paper, and some legal theories related to the journal's writing are analyzed.
